To the fullest extent permitted at law, we provide this website and its contents on an 'as is' basis. We make no (and expressly disclaim all) representations or warranties of any kind with respect to this website or its contents, including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, we do not represent or warrant that the information accessible via this website is accurate, complete or current.

Except as specifically stated on this website, to the fullest extent permitted at law, neither eProcure nor any of its affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with using this website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

eProcure provide our software-as-a-service (SaaS) using a high level of skill and care. eProcure provide the Services “as is” eProcure will not be responsible for lost profits, revenues, data, financial losses either direct or indirect, special, consequential, exemplary, or punitive damages.

Access to and use of the eProcure is subject to these terms and conditions. Tenderers must agree to comply with these terms and conditions and any applicable instructions, processes, procedures and recommendations as advised in this document. We therefore state that by proceeding to use the portal, you agree with the terms and conditions as stated.

It is the responsibility of tenderers to ensure that their infrastructure including operating system and browser revision levels meet the minimum standards. The agency issuing a Request For Tender or similar request or notice (herein RFT) DO NOT take any responsibility for any problems arising from tenderers' infrastructure and/or Internet connectivity.

Tenderers acknowledge that although eProcure has implemented security measures, eProcure does not warrant that unauthorised access to information and data transmitted via the Internet will not occur.

Tenderers may be informed by notices and other information issued as addenda or amendments posted on the eProcure platform..

Tenderers who have registered and downloaded the tender documentation or accessed the online form will be notified by eProcure via email of any addenda or amendment issuance. It is in the interest of tenderers to ensure they have correctly recorded their contact details prior to accessing the tender documentation / online form.

eProcure will accept no responsibility if a tenderer fails to become aware of any addendum or amendment notice which would have been apparent from a visit to the eProcure platform for the relevant RFT.

The material on this site includes information, data, documents, pages and images (Data) and is intended for your use and information. eProcure holds the copyright in the Data on this site and all rights are reserved.

You may download, store in cache, display, print and copy the Data in an unaltered form only, for non-commercial purposes, provided that this notice appears with all copies. The user agrees:

All Confidential Information and documents containing Confidential Information shall remain the property of the Party originally disclosing the Confidential Information.
Each party must not, and must ensure that its officers, employees advisers and subcontractors or agents do not, without the prior written consent of the other party disclose any Confidential Information of the other party; or retain, duplicate or use any Confidential Information of the other party other than for any other purpose than in connection with the response to bid.
Each Party shall make any Confidential Information provided by the other Party available to only those of its officers, employees, advisers and subcontractors or agents who need to know the Confidential Information in connection with the opportunity.

In relation to the Data eProcure disclaims all and any guarantees, undertakings and warranties, express or implied, and shall not be liable for any loss or damage whatsoever, including incidental or consequential loss or damage, arising out of, or in connection with, any use of or reliance on the Data on this platform.

While the Data is true and correct at the date of publication, changes in circumstances after the time of publication may impact on the accuracy of the Data. The Data may change without notice and eProcure is not liable for the accuracy of any information printed or stored by a user. Changes may be made to the Data and the website at any time and from time to time.

In addition to Data on this website, links are provided to external websites. These external sites are beyond the control of eProcure. It is the responsibility of the user to exercise their own skill and care with respect to the accuracy, completeness and currency of, or reliance on, any Data sourced from those external sites.

We provide these links for your convenience only, and do not necessarily endorse their content.

All persons who provide personal and organisational DETAILS within the eProcure platform, hold themselves to be a proper and authorised representative of that organisation in the business of tendering. If, subsequently, that person no longer has that right of authority, the person will send a request to the eProcure Administrator at info@eprocure.com.au to have such particulars removed or amended.

It is in the interest of users to register their details correctly, in particular prior to accessing tender information. eProcure will treat any information provided by a user within the terms of its relevant privacy responsibilities (see Privacy Statement).

It is your responsibility to ensure that the submission is fully compliant with the terms and conditions contained in the relevant tender documentation and any amendments thereto. eProcure will not be liable in any way for your failure for any reason to comply with such terms and conditions.

Tenderer must ensure that any RFx responded to is lodged before the closing date and time. You should thoroughly check the closing dates and times within any tender documentation or check directly with the buyer if in any doubt.

Tenderers lodging a tender response via eProcure should use file formats, sizes and naming conventions prescribed within the relevant tender documents. This may be a condition of compliance for tenderers.

By agreeing to these terms and conditions, you acknowledge that we cannot and will not act in any capacity (including, but not limited to, your agent or intermediary) with respect to influencing or amending the rules, practices or procedures of the buyer including, but not limited to, deadlines, information required or the format of your bid.

As a tenderer you have the responsibility for ensuring sufficient time for a successful lodgement. This includes time required for transmission and any problem analysis and resolution.

All successful Tenderer will be notified by the buyer directly. We do not accept any responsibility in processing any notification between buyer and Subscribers to our Services.

You release and indemnify us (and our officers, employees, agents and associates) from any and all claims, demands and damages whatsoever made against us by you and/or a third party (including a Customer ) in relation to the Services provided to you.
